Understanding Lawyers & Self-Representation

Everything you need to know about hiring a family lawyer, representing yourself, and managing legal costs in Australian family law proceedings.

How to Choose the Right Family Lawyer

Choosing the right lawyer can make or break your case. Not all lawyers are equal, and the most expensive is not always the best. Here's what to look for:

Specialisation Matters

LOOK FOR

A lawyer who specialises in family law and practises it daily

AVOID

A general practitioner who 'also does family law'

Check if they're an Accredited Specialist in Family Law (accredited by their state Law Society). This is the gold standard.

Communication Style

LOOK FOR

A lawyer who explains things in plain language and returns calls promptly

AVOID

A lawyer who uses jargon, is hard to reach, or makes you feel rushed

Your first consultation should feel like a conversation, not a lecture. If you don't understand them now, it won't improve.

Strategy vs. Aggression

LOOK FOR

A lawyer who is strategic, firm, and focused on outcomes

AVOID

A lawyer who is aggressive, combative, and escalates conflict unnecessarily

Aggressive lawyers cost more (more court time, more letters) and often get worse outcomes. The best lawyers are strategic negotiators.

Transparent Fees

LOOK FOR

Clear fee agreements, regular billing updates, and cost estimates for each stage

AVOID

Vague pricing, surprise bills, or reluctance to discuss costs

Ask for a written costs agreement and request monthly billing statements. Set a budget and ask your lawyer to work within it.

Realistic Expectations

LOOK FOR

A lawyer who gives honest assessments, even when it's not what you want to hear

AVOID

A lawyer who promises outcomes or tells you only what you want to hear

No lawyer can guarantee outcomes. If they promise you'll 'win', find another lawyer.
